Default Divorce Lawyer... HELP!!!

Perhaps this thread is inappropriate for posting on a model airplane forum.... but I really need help!! I am divorced and the Ex is trying to squeeze as much money out of me as she can! The lawyer I had was $200.00 an hour and at this point, I just can't swing that! I really need a Divorce lawyer in california who can just look at my situation and give me a bit of guidance....

Max... If this is not appropriate and warrents deleting... I understand...

I hate women like that. I was on jury duty at supreme court about a couple of weeks ago and we had a similar case like this. Needless to say the *itch didnt get sh*t. I was actually the foreman and got to read the decission out that we made. It felt so good to read it out because she was out to get more money from the poor fellow.

Unless she can PROVE with DOCUMENTS that things have changed since the FINAL DECREE. . . she's just blowing smoke. If you already have a FINAL done, then that is what she's going to have to live with unless she PAYS HER OWN LAWYER a retainer out of her pocket to file new papers.

Until you're served, don't sweat it. . .tell her she should have brought this up BEFORE the FINAL was signed by the judge.

I read that "I am divorced". You are done... live life. She'll drop it after a while. She's paying for a lawyer and haggling and you are the flying field spending no money. My ex did the same thing... She left me alone after she dropped $10,000 and realized it was OVER. We had no kids though.... that's going to make it difficult. They can't take you back to court and redo the money thing. Once it is done, it should be done...

I will explain a little more...

3 years ago, the judge ordered that I pay her $1400 per month Child Support and $750 per month Spousal Support. The spousal support was to go until Nov 30 of 2007. Well... she got married 3 weeks ago, and that terminates Spousal support. So... being the swell (Stupid) guy I am, I proposed to her that I would increase at this time my child support an amount in proportion to the raises in my salary. Since she had a "Wage Assignment" inacted, she is still getting the full $2200.00 per month, even though she got married. My company will not change that amount until a court order is received. I can not get a court order (economically) unless we come to an agreement.
So.. yes.. I could just do nothing, but until nov 30, she will continue to get an extra $750.00 per month. This is a legal question I have... is she s'posed to refund to me this amount even though my company continues to pay her? Can I in fact "Do nothing" and this is money owed to me? I am ordered to give her a certain percentage of my annual performance bonus every year, this amounts usually to a couple thousdand dollars... and I can get my money back from her by deducting her debt from this money.... but there are other issues as well.... the judge based the child support on the assumption she would at least get a minimum wage job. Since that time, she has had a baby, and taken custody of her two grandchildren because her oldest daughter (My Ex-Step-Daughter) is trash and uses drugs and had the babies takenb away by CPS. So.... she is claiming these 3 children as a "Hardship"... basically a hardship is a term used on the support spreadsheets that gives her points (Well.. money).. becuase a "Hardship" makes it more difficult for her to have a job. She is now married right.. well.. in my mind, he can watch the kids at night while she gets a job!!!! (But would a judge see this?) It seems to me and my little mind that for me to pay her more money because of these "Hardships" is like ME paying Childsupport for kids that aren't mine!!! (But would a judge see it this way??)

This is a horrible story that seems to happen everyday. In the end the ones that miss out on the most is the kids. This is very sad. I wish you the best of luck with this matter. I wish I could help out in some way. I have a real weak spot for kids. I really hope they are not scared to much by this.

Yeah... I think you should go ahead with an attourney. I called my friend in Cali and left a message. He's reasonable and is an airplane nut. He's a good and fair guy.

Gotta agree. . . get an attorney and let him cut thru the B.S. Just don't let him get into the "letter writing" game where the two attorneys send $100 letters back and forth "arguing". Tell him you want to cut straight to the bottom - either get you a settlement or a court date - PERIOD, PRONTO.

I'd tell you to hire an attorney if you can. If not, go pro-se and do it yourself. I went pro-se, wrote my own motions, represented the facts to the judge myself, and did ok. Just get some legal advice or hire an attorney to represent you at the hearing. PM me and I'll help you if I can. I'm not an attorney but, I'm a huge advocate for father's rights.
