Actually the shape of the overall surface is all that matters the shape of the elevator has nothing to do with it. Therefore the counterbalances are legal.

The wing fairings are designed to smooth air around where it meets the fuselage, reducing drag and lateral lift. Really, if it were scale, the Katana would be the worst IMAC airplane you could build.
