As I understand it, you are correct about the liability of not having the CE mark. I am surprised they were allowed into the country. It is possible there was a declaration of conformity (DOC) document that shipped with them, but I believe there is a requirement for marking of the product as well.

I believe only a portion of the 2.4ghz band is limited power in France. There is a "France" switch on the radios for this reason, when switched they will avoid using the low power frequencies.

No I didn't miss it Dick, I was just trying to be nice figuring it was a typo since that would be 1/10th of the frequency range, not the power output...

The information about the various power output limitations given by Davelucas corresponds to what I've seen posted by that English tech guy over on the "other" forum.
