Initially the 400ft rule was suppose to be for commercial operations or when flying a model aircraft operation within 5 miles of an airport, with their permission of course.
It is unclear to me when, or even if, the 400ft limit became the limit for all suas everywhere.

General Aviation

General aviation refers to any nonscheduled, nonmilitary flight operation—in other words, all civil aircraft not flown by commercial carriers or the military. It includes everything from personal to business flying, air taxi, sightseeing tours, and life-saving medical flights. General aviation accounts for nearly 80 percent of the civil aircraft and three-fourths of all flight operations in the United States.

I stand corrected.

Reading through this thread, I have noticed the term of "toy's" being applied to fixed wing and other types aircraft that relates to our hobby. Ironic though, because the first thing that I see when I open up a new "ARF" and pick up the build manual is the following, "THIS IS NOT A TOY."

Sent to my AMA VP - District IV

The addition of the GP MR sig is at best dancing with the devil (although I don’t disagree with the SIG’s formation) – The AMA should have made the distinction between MR (multi rotor) and Drone long ago. While I view the MR guys as no different than helicopter folks the Drone folks are NOT us. The executive council needs to define the difference and kick the drone folks to the curb as they have us.

A drone – an airborne vehicle capable of autonomous flight
A MR – an airborne vehicle incapable of flight without a pilot controlling all aspects of the vehicle’s flight – i.e. yaw, pitch, roll, speed and altitude

Put simply a drone will stay airborne without a pilot’s intervention, a MR will yard sale itself without a knowledgeable pilot in command

The FAA registration horse has left the barn – I see it no different that full scale tail numbers – BUT this ain’t over. Screw DJI, they could have firmware locked their drones to 400 or 500 feet and made all population centers a no fly zone but they didn’t – The AMA needs for everyone to understand that we have to fly our airborne contrivances – the drone folks don’t and they are not part of our hobby.

The 400ft altitude limit appeared in both Advisory Circulars, AC91-57 and AC91-57A, which were guidelines for model aircraft operations but not actual regulations.
I guess as far back as 1981 we have followed those guidelines accompanied with a wink and a smile.

No wink or smile needed. AC's are strictly advisory in nature and are not in any way rules or regulations. Look at Section 336 and the proposed Part 101.41 and neither one mentions altitude limits for hobby flights. Part 107, which will govern commercial flights, is proposed to use 500 feet. So go figure.

A lot of bad information in this thread, but also some good stuff. If we, as RC hobbiests, cannot stand together we will surely fall apart.

I was in best buy today and they sell those drones so I had to ask and they told me that to purchase on you must now register I also tried the sim they had set up for a nice one and it has warning that pops up on the screen when you go to high I was surprised that they did more than just sell them and you also must be at least 17 to buy it seems as if they are at least trying to educate some its better than nothing the grizzz

Just saw a Amazon Prime Air video featured on youtube. They mention 400ft cruising altitude. They are plowing ahead with the project. A relatively small group of hobbists are not going to stand in the way of progress and money.

Anyone who has been in a club that lost a flying site knows we don't carry much weight in government decisions. It's just too easy to say no. We really don't offer much financially, and there is a liability to officials.
