Model airplanes banned in Romania

Ministry of Transport

Order no. 8/2014 to establish the operating conditions in the national airspace to civilian aircraft powered unmanned

Due to the continuous development of the aviation industry in the manufacture and use of unmanned aircraft , taking into account that international standards have not been established common certification and operation of civil aircraft without a pilot on board, taking into account that the EU regulatory package unmanned civil aircraft with maximum take-off mass exceeding 150 kg, to be completed by 2016 , while civil unmanned aircraft with MTOM of less than 150 kg, remain subject to national regulations issued by Member States of the European Union to allow operation of the national airspace to civilian aircraft powered unmanned until the issuance of European and national regulatory package specific covering both certification and the operation of such aircraft, pursuant to Art. 4 lit. b ) and f ) of Government Ordinance no. 29/1997 on civil aviation code , republished, with subsequent amendments , and art. 5 para. ( 4) of Government Decision no. 24/2013 on the organization and functioning of the Ministry of Transport , as amended and supplemented, Transport Minister issues the following order :

Article 1 .

(1) The operation of civil aircraft powered unmanned national airspace is permitted only in areas segregated airspace temporarily created , allocated and activated in accordance with applicable regulations in force.

( 2 ) The areas referred to in para. (1) is set entirely in Class G airspace and their upper vertical limit must be at least 150 m below the lower limit of controlled airspace .

( 3) The request for the establishment of the area under par. (1) shall be transmitted by the aircraft operator Romanian Civil Aviation Authority at least 45 days before the date set for commencement of work . The application and information underlying the documents required to be attached thereto shall be published on its website the Romanian Civil Aviation Authority www.caa.ro.

( 4 ) The allocation and activation zones referred to in para. ( 1) shall be made ​​in accordance with applicable aviation regulations .

Article 2 .

For the purposes of this Order , the terms and expressions have the following meanings :

a) The operator of the aircraft - natural or legal person who carries out civil aircraft motorized aerial unmanned and asking this purpose the establishment of a temporary segregated airspace areas under this order;

b ) Class G airspace - defined area of airspace are not provided air traffic control services .

Article 3 .

A motorized civil aircraft and unmanned MTOM greater than 150 kg can be operated in national airspace, in compliance with the requirement in art . 1 para. (1) and (2 ) only if the following conditions are met :

a) holds a certificate of registration ;

b ) holds a type certificate and an airworthiness certificate in accordance with European regulations issued under Regulation (EC ) no. 216/2008 of the European Parliament and of the Council of 20 February 2008 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency , and repealing Council Directive 91/670/EEC , Regulation (EC ) no. 1.592/2002 and Directive 2004/36/EC ;

c ) the aircraft operator 's certificate , as appropriate, according to civil air operations conducted in accordance with applicable aviation regulations issued nationally or those issued in the European Union ;

d ) the aircraft is provided by law for damages caused to third parties .

Article 4 .

A motorized civil aircraft and unmanned MTOM less than or equal to 150 kg can be operated in national airspace, in compliance with the requirement in art . 1 para. (1) and (2 ) only if the following conditions are met :

a) holds a certificate of identification issued by the Romanian Civil Aviation Authority or a registration certificate or equivalent document issued by another state;

b ) if the aircraft has a maximum take-off mass exceeding 15 kg , has a national permit to fly issued by the Romanian Civil Aviation Authority or equivalent technical certification document issued by another state, recognized by the Romanian Civil Aviation Authority ;

c ) the aircraft is provided , where appropriate , by law, for damages caused to third parties .

Article 5 .

(1) Nothing in this order does not relieve the operator of a civil aircraft powered unmanned requirement of compliance with the Government Decision no. 912/2010 for the approval of the authorization of flights in the national airspace , and the conditions under which civil aircraft taking off and landing can be made and from / to other land or water surfaces than certified aerodromes , as amended and supplemented, when performing civil air operations in the national airspace .

( 2) This Order shall not apply to:

a) Model Aircraft , as they are defined and classified by the International Federation and the Federation of Romanian aircraft use of models, when used in competitions , demonstrations or other aerial demonstrations organized by the Federation of Romanian official of Modeling ;

b ) civil aircraft powered unmanned and MTOM exceeding 1 kg , so long as :

- Are operated in an open area without buildings used for housing;

- Operated without exceeding the field of view of the person that provides control of the aircraft from the ground, but not more than 150 m away on the horizontal and height 100 m away from the front of the person ;

- They have not mounted equipment for filming and data transmission .

( 3 ) The responsibility for any damage caused as a result of model planes and aircraft operating under par. ( 2 ) lies with the people who provide their command from the ground .

Article 6 .

(1) Within 30 days after the entry into force of this Order, the Romanian Civil Aviation Authority published on its website , www.caa.ro , documents and information referred to in art . 1 para. ( 3).

( 2 ) Until 30 June 2015, Romanian Civil Aeronautical Authority shall prepare and submit for approval to the Minister of Transport projects of national civil aviation regulations in the operation of the national airspace to civilian aircraft powered unmanned and have maximum take-off mass than or equal to 150 kg.

Article 7 .

This order shall be published in the Official Gazette of Romania, Part I, and enter into force 30 days after publication .

Article 8 .

This order shall apply until 30 January 2016.

So it seems model airplanes are not, in fact, banned.

Yeah, don't look like they are "banned"....BUT 100 meters in height and 150 meters to the left or right or in front makes a pretty tight "box" to fly in......looks like pretty much limited to park flyers.

Looks like you're stuck flying foamies for a while, unless you got OUTLAW!

I didn't see anything about a ban, just a reclassification of airspace. Still, it is a major impediment for the hobbyist to participate in our hobby with such a small flight area. In the US we have a hard ceiling of 400' per the AMA. I don't know anyone with altimeters in their airplanes. Most of these rules are a knee jerk reaction to recent technological innovations, and the government just wants to get some guidelines in place. I'd be amazed if guys in black suits came out to audit your flying site, and "box."

If RC became illegal in the US I would be the first to break the law! I'd find some far off place and fly to my hearts content.

Interestingly, this order is given by the Ministry of Transport , although model airplanes in Romania is the Romanian Federation of Modelis tutelage , which is under the Ministry of Youth and Sports. We are a small community of several thousand members representing Romanian model airplanes hobby level . Model airplanes is an art , and dates back to 1936 ( year of establishment FAI Aeromodelling Commission) is practiced worldwide in all countries , more than him being the starting point for children who practice it , the way to aviation schools , the colleges and faculties profile . For most large model airplanes is a form of expression , relaxation and last but not least is the skill of the sport of the mind .

Although we are a small fraction of registered athletes affiliated clubs Romanian Federation Modeling ( FRMD ) , most practice the sport purely recreational level without being involved in the competition field. The entire community welcomes the initiative of the Ministry of Transport to legislate , in one form or another sport. However , the current ban order issued on 01/24/2013 at hobby sport virtually all aeromodelistii will be forced to join a club affiliated FRMD , which is virtually impossible for those living in small towns because there are clubs in most aircraft use .

Looks to me like paragraph a) gives relief from the tiny box. It seems to say that "when used in competitions , demonstrations or other aerial demonstrations organized by the Federation of Romanian official of Modeling" there are no box requirements. If you are flying with the Romanian official of Modeling sanction you have to comply with paragraph b).

That is not unlike what is currently true in US. If you comply with AMA you are OK.

It does sound like you need to get real friendly with the Romanian Office so that you can create 1 or 2 person clubs, with competitions in "The Art of Aerial Flight", or "Large Scale Air Molecule Pushing" or just "Number of flights without using a scorecard".
